Understanding Resident Welfare Associations (RWA) and Buyer Welfare Associations

Resident Welfare Association (RWA) serves as a civic body representing the interests of residents within a society or specific locality. RWAs are typically formed by groups of resident owners, with registration requirements varying slightly from state to state.

Formation of RWAs:

A minimum of 7 members within the state can apply for RWA registration with the Jurisdictional Registrar Office. In certain states, builder apartments or group housing societies are covered under state Apartment Acts, where Apartment Owners Associations (AOAs) are formed. In other cases, RWAs can be established. For instance, residents of Noida Sector 34 Block C can form an RWA as they are not part of a group housing society and are not covered by the UP Apartment Act.

Buyer Welfare Associations:

Buyer Welfare Associations are formed by a minimum of 7 members with the Jurisdictional Registrar Office under the Society Registration Act, 1860. These associations are typically established by buyers who have not received possession of their flats, are awaiting registration, or have not obtained building completion certificates. Buyer Welfare Associations aim to advocate for buyers' rights and address issues with builders.

Formation of Welfare Associations:

Under the Society Registration Act, 1860, Welfare Associations can be formed at either the state or central level. At the state level, a minimum of 7 members from the same state can form an association, while at the central level, 7 members from each state are required for establishment.

RWA/Buyers Association Registration Process in India

Procedure for RWA or Buyers Welfare Association Registration

  • Document Preparation: Gather all required documents according to the guidelines of the applicable state's Society Registration Act, State Apartment Act, or the Society Registration Act, 1860. Follow the guidelines issued by the Registrar.
  • Name Selection: Decide on the name of the RWA or Buyers Association in accordance with the regulations.
  • Drafting Bye-Laws: Prepare Bye-Laws based on the Model Bye-Laws provided in the relevant Act of the state. Professional assistance may be sought for drafting.
  • Application Filing: Submit the application along with the necessary documents and Bye-Laws to the jurisdictional Registrar. The filing process may be online or offline, depending on the state's procedures.
  • Fee Payment: Pay the government fees using online, cash, or any other accepted mode of payment by the registering authority.
  • Issuance of Registration Certificate: Upon approval of the name and Bye-Laws, the Registrar issues the Registration Certificate. This process typically takes between 25 to 90 days under normal circumstances.
