Shop and Establishment Registration, commonly referred to as a 'Trade License' in many states and known as a 'Gumasta License' in Maharashtra, is governed by the Shops and Commercial Establishments Act of 1958. This act was implemented to regulate the working hours, weekly/monthly offs, payment of wages, employment terms and conditions, holidays, and leave policies for individuals employed in shops and commercial establishments.
The authority responsible for issuing trade licenses varies from state to state, resulting in different rules and regulations as per the respective State Shops and Establishment Act or other specific acts governing shops and establishments within each state. Consequently, the process and required documentation may also vary slightly across states.
Employers are required to register their establishments within 30 days from the commencement of work by submitting a statement along with the prescribed fees to the Chief Inspector of the relevant area. However, the registration period may differ in some states. The Municipal Corporation or Local Authority of the respective state or locality is the department responsible for issuing trade licenses.
This Act establishes rules for daily and weekly working hours, guidelines for spread-over and rest intervals, and specifies opening and closing times, closed days, national and religious holidays, and overtime work. It includes regulations for the employment of children, young persons, and women, and sets forth rules for annual leave, maternity leave, sick leave, and casual leave. Additionally, it outlines the regulations for employment and termination of service, the maintenance of registers and records, the display of notices, and the obligations of both employers and employees.
