How to Apply for Tax Exemption under Section 80 IAC:

To be eligible for a tax holiday under Section 80 IAC of the Income Tax Act, a Startup must first obtain a DPIIT Certificate (Startup Recognition Certificate). Once this certificate is secured, the Startup can then apply for a tax exemption, allowing for a tax holiday for three consecutive financial years out of its first ten years since incorporation. Eligibility Criteria for Income Tax Exemption (Section 80 IAC):

  • Recognized Startup: The entity must be officially recognized as a Startup.
  • Entity Type: Only Private Limited Companies or Limited Liability Partnerships (LLPs) are eligible for this tax exemption.
  • Incorporation Date: The Startup must have been incorporated after 1st April, 2016.

Steps to Apply for Tax Exemption:

Step 1: Obtain DPIIT Startup Certificate

  • • If you operate a Private Limited Company or an LLP but do not yet have a DPIIT Startup Certificate, your first step is to apply for this recognition.

Step 2: Apply for Tax Exemption

Once you have obtained your DPIIT Startup Certificate, you can proceed to apply for the tax exemption under Section 80 IAC.
