Understanding FCRA Registration for NGOs

The Foreign Contribution Regulation Act (FCRA) registration is crucial for NGOs seeking contributions from foreign donors. Without FCRA registration, an NGO cannot legally receive foreign donations in India. This Act governs all foreign donations received in India for religious, charitable, social, or environmental causes, regardless of whether they are from foreign individuals, companies, societies, governments, or organizations.

Approval Process and Conditions

  • The registration is granted to organizations registered under the Societies Registration Act 1860, Indian Trust Act 1882, Charitable and Religious Trust Act 1920, or as a Section 8 Company.
  • It can be provided as Prior Permission under section 6(1A) or Permanent Permission under section 6(1)(a).
  • The registration process typically takes 4 months to 1 year or more and involves thorough documentation and investigation by the Ministry of Home Affairs (MHA).
  • Yearly compliance is mandatory for NGOs registered under FCRA.
  • An organization can have only one FCRA account in any Scheduled Commercial Bank of India.
  • Banks are instructed by the MHA post-approval to monitor foreign donation transactions and report annual receipts.
  • The FCRA account must be maintained separately from local receipts.
  • The FC-3 form is used for FCRA application.
  • Any NGO that is at least 3 years old can apply for FCRA registration.
